All property offered and sold through 1837 Auctions., ("Auctioneer", or "Broker", or the "Company") shall be offered and sold on the terms and conditions set forth in these Conditions of Sale. By participating in any sale, you acknowledge that you are bound by these terms and conditions. 1837 Auctions. has made every effort to catalogue and describe accurately property to be sold. The Company, however, assumes no risk, liability or responsibility for the identification or authenticity or authorship, or weight, count, or measure of any property identified in its catalogue or lists of sale. This shall include, among others, the identity of the creator, the period, culture, source of origin, as the case may be, with which the creation of any property is identified in any publication.

Warranties and Representations:

ALL PROPERTY IS SOLD "AS IS". THE CONSIGNOR MAKES NO WARRANTIES OR REPRESENTATIONS OF ANY KIND WITH RESPECT TO ANY PROPERTY OFFERED FOR SALE, SINCE THE AUCTIONEER IS ACTING SOLELY AS AN AUCTION BROKER, AND, UNLESS OTHERWISE STATED, DOES NOT OWN THE PROPERTY OFFERED FOR SALE. THEREFORE, THE AUCTIONEER MAKES NO WARRANTY OF TITLE, WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, OR ANY OTHER WARRANTY OR REPRESENTATION OF ANY KIND OR NATURE WITH RESPECT TO THE PROPERTY.


Refunds:

ALL SALES ARE FINAL - NO REFUNDS AND NO EXCHANGES. WE AND THE CONSIGNOR DISCLAIM ANY AND ALL WARRANTIES, EXPRESSED OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR ANY PARTICULAR PURPOSE. NO WARRANTIES ARE MADE THAT ANY OF THE MERCHANDISE COMPLIES WITH ANY APPLICABLE GOVERNMENTAL RULES, REGULATIONS OR ORDINANCES OF ANY KIND OR NATURE WHATSOEVER.
BEFORE THE SALE ALL BUYERS ARE STRONGLY ADVISED TO INSPECT ALL ITEMS BEFORE AUCTION AS ALL ITEMS ARE SOLD AS IS, WHERE IS.

PAYMENT AND PICKUP:

All major credit/debit cards, cashier's check and paypal will be accepted during and after the sale. Payments must be completed by 5:00 PM within 7 calendar days following each auction or the bidder will have a dispute placed against them.

Storage:

The invoice must be paid in full and shipping arrangements made within three days of the date of sale.

SALES TAX:

Indiana State sales tax will be applied to all in house invoices and any online invoices where the bidder resides in Indiana. A completed tax exemption certificate is required at time of registration for all buyers who wish to qualify for tax exemption. Buyer is responsible for payment for all successful bids. Any item not paid for by the deadline may be returned to the sales floor and will be eligible for resale.
a.    All taxes assessed or imposed by the United States, the State of Indiana, or any other government entity on this transaction will be paid by the buyer direct to the agency due, if applicable.
b.    Buyers are responsible for the removal of all their purchases. 1837 Auctions, does not deliver.

RISK OF LOSS
In the event delivery cannot be made because of loss due to fire, theft, or any other reason, 1837 Auctions. shall only be liable for the return of any deposits or payments made by the purchaser.

BID DISCREPANCIES:

In case of any discrepancy, from any source, the
auctioneer's record is the official record of the sale. In case of any tie
bids, the auctioneer's ruling is final. 1837 Auctions. will have
sole and absolute discretion to determine who the successful bidder is
and/or may withdraw the Lot or reoffer the Lot for sale, in the event of a
dispute.

BUYER'S PREMIUM:

Buyer agrees to pay 1837 Auctions a buyer's
premium based on winning bid amounts of 20%

ESTIMATES:

Auction price estimates are given on each lot. Estimates
should not be relied on as a prediction of the actual selling price or the
actual value of any lot.

MODIFICATIONS:

1837 Auctions reserves the right to modify,
add, or remove any section of these terms and conditions of sale at any
time, with or without notice.

SHIPPING:

Shipping cost is the responsibility of the purchaser. Merchandise will be picked up, packaged or shipped by arrangements made by 1837 Auctions via 3rd party shipping.  (Merchandise must be removed with 10 days after the auction date) ANY ITEMS NOT REMOVE ARE SUBJECT TO $10 PER DAY PER ITEM STORAGE FEE. 1837 Auctions has the right to sell any items left over 30 days. All invoices are due to be paid within 7 business days. All items are sold and shipped As Is. Some property that is sold at auction can be subject to laws governing export from the U.S., such as items that include material from some endangered species. Import restrictions from foreign countries are subject to these same governing laws. Note there will most likely be import taxes at your country’s border. Granting of licensing for import or export of goods from local authorities is the sole responsibility of the buyer.
